Terms of Service

Welcome to Wowch. We're glad you're here. These Terms of Service (the "Terms") are the agreement between you and Innolope LLC ("Innolope," "Wowch," "we," "us," or "our"), the company that builds and operates the Wowch mobile app and website (together, the "Service"). We've done our best to write them in plain, readable language, because we'd genuinely like you to understand the agreement you're entering into rather than skim past it.
By creating an account, downloading the app, or otherwise using Wowch, you're agreeing to these Terms and to our Privacy Policy, which is incorporated here by reference. If you don't agree with something in here, that's completely understandable — but in that case please don't use the Service. If you're using Wowch on behalf of an organization, you're confirming that you have the authority to accept these Terms for that organization.
1. Who we are
Wowch is a product of Innolope LLC, a limited liability company registered in the State of Delaware, United States. Our registered address is Ste A, 8 The Green, Dover, DE, Kent, US, 19901. The best way to reach us about anything in these Terms is by email at [email protected]. Wowch helps people discover restaurants, cafés, attractions, and other places through short, authentic video reviews created by real people, and it lets you contribute your own reviews, vote, comment, and earn rewards for taking part.
2. Eligibility and your account
To use Wowch you need to be at least 13 years old, and old enough to form a binding contract with us in the country where you live. If you're under the age of majority in your jurisdiction, you should review these Terms with a parent or guardian. By using the Service, you're confirming that you meet these requirements and that the information you give us when registering is accurate.
You're responsible for the activity that happens under your account and for keeping your login credentials secure. Please don't share your account, and let us know promptly at [email protected] if you suspect any unauthorized use. We may offer sign-in through third parties such as Apple or Google; when you use those options, your use of that provider is also governed by their own terms.
3. Your content and the reviews you share
Wowch is built around content that you and other members create — the videos, captions, comments, ratings, and other material you post (your "Content"). You keep ownership of your Content. We don't claim to own it, and we don't want to. That said, in order to actually run the Service — to store your video, transcode it, show it to other people, feature it in a city feed, and let others discover it — we need your permission to use it.
So, by posting Content on Wowch, you grant Innolope a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for example, to resize or transcode for different devices), publish, publicly display, and distribute that Content in connection with operating, promoting, and improving the Service. This license lasts for as long as your Content is on Wowch, and for a reasonable period afterward while backups and cached copies are cleared. If you delete your Content or your account, we'll stop displaying it publicly, though copies may persist in backups for a limited time and others may have re-shared it.
You're responsible for the Content you post, and by posting it you promise that you have the rights to do so, that it's truthful to your genuine experience, and that it doesn't infringe anyone else's rights or break the law. Please only post reviews of places you've actually visited and experiences you've actually had — authenticity is the entire point of Wowch, and misleading or fake reviews undermine everyone's trust.
4. Community guidelines and acceptable use
Wowch only works when it feels safe, honest, and welcoming. To keep it that way, you agree not to use the Service to do any of the following:
- Post content that is unlawful, defamatory, harassing, hateful, threatening, or that incites violence against any person or group.
- Share sexually explicit material, graphic violence, or content that exploits or endangers minors.
- Post fake, paid-for, or deliberately misleading reviews, or impersonate another person, business, or Wowch itself.
- Infringe anyone's intellectual property, privacy, or publicity rights, or share someone else's private information without permission.
- Upload viruses or malicious code, attempt to gain unauthorized access to our systems, scrape the Service, or interfere with its normal operation.
- Use bots, automation, or other schemes to inflate votes, rewards, or engagement, or to abuse our rewards program.
- Use the Service for spam, unsolicited advertising, or any commercial exploitation we haven't authorized in writing.
We may review, moderate, remove, or restrict Content that we reasonably believe violates these Terms or could harm the community, our users, or Innolope. We won't always catch everything, and we don't pre-screen most Content, but we take reports seriously. If you see something that shouldn't be on Wowch, please tell us at [email protected].
5. Rewards and points
Wowch may let you earn points, badges, or other rewards for contributing reviews and taking part in the community. These rewards are a fun way to recognize participation — they have no cash value, aren't your property, can't be transferred or exchanged for money, and may be changed, adjusted, or discontinued at our discretion. We may also reverse rewards that were earned through fraud, error, or activity that breaks these Terms.
6. Subscriptions, purchases, and payments
Some features of Wowch may be offered as paid subscriptions or one-time purchases. When you buy through an app store (such as the Apple App Store or Google Play), the transaction is processed by that store and is subject to its terms, and any refunds are handled according to that store's policies. We may also process payments through our payment partners. Subscriptions renew automatically for the period you selected unless you cancel before the renewal date, and you can manage or cancel your subscription through your app store account settings. Prices, plans, and features may change over time, and we'll give you notice of material changes where required.
7. Intellectual property in the Service
Everything that makes up Wowch other than user Content — the app, the website, our name, logo, design, software, and the arrangement of it all — belongs to Innolope or our licensors and is protected by intellectual property laws. We're happy for you to use the Service as intended, but that doesn't give you the right to copy, resell, reverse-engineer, or build a competing product from it. Please don't use the Wowch name or logo in a way that suggests we endorse you without our written permission.
8. Third-party services and links
Wowch relies on trusted third parties for things like cloud hosting, media delivery, authentication, analytics, and payments, and it may contain links to places, websites, or services we don't control. We're not responsible for the content, policies, or practices of those third parties, and your dealings with them are between you and them. We encourage you to read their terms and privacy policies where relevant.
9. Disclaimers
We work hard to make Wowch reliable, useful, and enjoyable, but we have to be honest about the limits. The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Reviews on Wowch reflect the personal opinions of the people who post them, not our own — we don't independently verify every review, and we can't guarantee that any place will match your expectations. To the fullest extent permitted by law, we don't warrant that the Service will be uninterrupted, error-free, or completely secure.
10. Limitation of liability
To the fullest extent permitted by law, Innolope and its officers, employees, and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Where liability can't be excluded, our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars (USD 100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold Innolope harmless from any claims, damages, losses, and reasonable legal costs that arise out of your Content, your use of the Service, or your breach of these Terms — except to the extent those claims are caused by our own wrongdoing.
12. Suspension and termination
You're free to stop using Wowch and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we're required to by law, or if we reasonably need to in order to protect the community or the Service. Where it's appropriate and lawful to do so, we'll give you notice and a chance to put things right. Sections of these Terms that by their nature should survive termination — such as content licenses already granted, disclaimers, limitations of liability, and indemnities — will continue to apply.
13. Changes to these Terms and to the Service
Wowch will keep evolving, and these Terms may change along with it. When we make material changes, we'll update the "Last updated" date above and, where appropriate, let you know within the app or by email. If you keep using the Service after the changes take effect, that means you accept the updated Terms. We may also add, change, or remove features of the Service over time as we improve it.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If a dispute arises between us, we'd genuinely prefer to sort it out amicably first — so please reach out to [email protected] and give us a fair chance to help. If we can't resolve it informally, the state and federal courts located in Delaware will have jurisdiction, unless mandatory law in your country of residence gives you the right to bring proceedings elsewhere.
